Homicide is any act that directly or indirectly causes the death of another person.  There are several charges that involve homicide: first degree murder, second degree murder, manslaughter, infanticide and criminal negligence causing death.

First Degree Murder

First Degree Murder is the planned and deliberate killing of a person or murder in the course of a forcible confinement or murder of a police officer.  There is a mandatory life sentence with no possibility of parole for at least 25 years.

Second Degree Murder

Second Degree Murder is the intentional killing of another person without planning and premeditation.  The sentence is a mandatory life sentence.  The Judge sets a minimum parole between 10 and 25 years. 


Manslaughter is the unintentional killing of a person.  The sentence will often depend on the individual factors in a specific case as the Criminal Code allows sentences ranging from probation to life in prison.
